Welcome to Elderly ("we," "our," or "us"), a platform connecting elders with qualified caregivers in Sri Lanka and surrounding regions. These Terms and Conditions ("Terms") govern your use of our services and form a legally binding agreement between you and Elderly.

By accessing or using our platform, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.

2. Acceptance of Terms

4. User Responsibilities

All caregivers must meet the following minimum requirements:

  • Health Certificate: Current medical fitness certificate
  • Training: Basic caregiving or first aid certification
  • References: Minimum two professional references
  • Profile Photo: Clear, professional headshot required

Ongoing Obligations

  • Maintain current certifications and licenses
  • Provide care services with professionalism and respect
  • Follow all safety protocols and guidelines
  • Report any incidents or concerns immediately
  • Participate in periodic training and evaluation programs

In case of emergency during a care session:

7. Privacy & Security

8. Payments & Refunds

  • Emergency Cancellations: Case-by-case evaluation with documentation

Billing Disputes

If you have questions about charges or need to dispute a payment, please contact our support team within 30 days of the transaction. We will investigate and resolve billing issues promptly and fairly.

9. Liability & Disclaimers

Platform Role

Elderly operates as a platform that facilitates connections between elders and caregivers. We are not a healthcare provider and do not directly provide medical or care services.

⚠️ Important Disclaimers

  • We cannot guarantee the availability of caregivers at all times
  • While we screen caregivers, we cannot guarantee their performance
  • Users are responsible for verifying caregiver credentials independently
  • Emergency situations should always involve professional emergency services

Limitation of Liability

To the maximum extent permitted by law, Elderly's liability for any damages arising from the use of our services is limited to the amount paid for the specific service in question. We are not liable for indirect, incidental, or consequential damages.

Indemnification

Users agree to indemnify and hold Elderly harmless from any claims, damages, or expenses arising from their use of the platform or violation of these Terms.

10. Termination

Termination by User

You may terminate your account at any time by contacting our support team or using the account deletion feature in your profile settings. Upon termination:

  • Your account will be deactivated within 24 hours
  • Personal data will be deleted according to our Privacy Policy
  • Outstanding payments and obligations remain valid
  • You may lose access to historical data and records

Termination by Elderly

We reserve the right to suspend or terminate accounts for violations of these Terms, including but not limited to:

  • Fraudulent activity or misrepresentation
  • Violation of safety policies
  • Harassment or abuse of other users
  • Non-payment of fees or charges
  • Illegal activities or regulatory violations
